Indemnity and Risk Policy
Introduction
By participating in any programme or activity organised by Viriya Community Services (VCS), you acknowledge and agree to the following terms:
1. Acknowledgment of Risks and Physical Readiness
You acknowledge that participation in VCS programmes, events, or activities involves inherent risks, including but not limited to physical, emotional, and health-related risks. It is your responsibility to ensure that you (or your child/ward) are physically and mentally prepared for these activities.
You confirm that you (or your child/ward) are in good health and capable of participating in the planned activities.
If you (or your child/ward) have concerns about your health, mobility, or fitness, you agree to inform VCS staff before or during the activity to ensure participation is safe and appropriate.
2. Medical Disclosure
You acknowledge that it is your responsibility to disclose any relevant medical information that may affect your ability to safely participate in the programme/event/activity. You agree to inform VCS of any pre-existing medical conditions, injuries, or other health concerns prior to or during the activity. Failure to disclose such information may limit the applicability of this indemnity policy.
3. Insurance and Liability for Loss, Damage, or Injury
Participants are strongly advised to purchase insurance policies to cover potential injuries, loss of property, or any other personal losses they deem necessary for participation in the programme.
You acknowledge that certain activities may involve significant physical exertion and inherent risks. You agree to release and discharge VCS, its affiliates, employees, volunteers, representatives, and agents from any liability for accidents, injuries, including the aggravation of pre-existing medical conditions, loss of life, damage to property, or any other losses arising from or in connection with your (or your child/ward’s) participation in the programme/event/activity.
This indemnity does not apply in cases of gross negligence or wilful misconduct by VCS.
4. Medical Treatment and Emergency Medical Care
You understand that there may be no medical supervision available during the programme/event/activity. In case of injury or illness, you consent to receiving medical treatment and first aid. You also authorise VCS to arrange transportation to a hospital by ambulance if necessary, and you understand that any follow-up medical care will be provided at a local hospital. Any medical treatment required beyond first aid will be at your own expense.
5. Permission for Transportation
You grant permission for VCS to transport you (or your child/ward) in vehicles operated by VCS employees or contractors during the programme/event/activity.
6. Underage Participants
If the participant is under the age of 21, this indemnity must be consented to by a parent or legal guardian who agrees to these terms on behalf of the minor. The parent/guardian is responsible for ensuring that the minor is fit to participate and understands the associated risks.
7. Withdrawal of Consent
You have the right to withdraw your consent at any time before or during the programme/event/activity. If you wish to withdraw consent, please contact VCS at the provided contact details.
8. Changes to the Policy
VCS reserves the right to update or amend this Indemnity Policy at any time. Any changes will be communicated to participants, and updated versions will be made available on our website.
Conclusion
By submitting this form or registering for the programme/event/activity, you acknowledge that you have read, understood, and agree to the terms outlined in this Indemnity Policy.
